All photographs taken by Sumit Photography are the exclusive property of Sumit Photography. The client does not acquire any rights, title, or interest in the photographs, including the copyright, unless explicitly stated in a written agreement signed by Sumit Photography.

*2. Usage Rights*

The client is granted a non-exclusive, non-transferable, and non-assignable license to use the photographs for personal, non-commercial purposes only. Any commercial use, reproduction, or distribution of the photographs requires prior written consent from Sumit Photography.

*3. Model Releases*

If the photographs include recognizable individuals, it is the client's responsibility to obtain model releases from the individuals depicted in the photographs. Sumit Photography is not liable for any claims or damages arising from the client's failure to obtain model releases.

*4. Liability and Indemnification*

Sumit Photography is not liable for any damages, losses, or expenses arising from the use of the photographs, including but not limited to, loss of profits, business interruption, or reputational harm. The client agrees to indemnify and hold harmless Sumit Photography, its officers, directors, employees, and agents from any claims, demands, or actions arising from the client's use of the photographs.

*5. Warranty and Disclaimer of Warranties*

Sumit Photography makes no warranties, express or implied, regarding the photographs, including but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. The client acknowledges that the photographs are provided "as is" and "as available" without any warranty of any kind.

*6. Limitation of Liability*

In no event will Sumit Photography be liable for any indirect, incidental, special, or consequential damages arising from the use of the photographs, even if Sumit Photography has been advised of the possibility of such damages.

*7. Governing Law and Jurisdiction*

This disclaimer shall be governed by and construed in accordance with the laws of India. Any disputes arising from this disclaimer shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.

*8. Entire Agreement*

This disclaimer constitutes the entire agreement between the client and Sumit Photography regarding the use of the photographs and supersedes all prior agreements, understandings, and discussions.
